Must I Undergo an Asbestos Survey?
Yes, the Health & Safety Executive has now issued the new revised legislations regarding surveying for asbestos in workplace buildings this includes managed properties i.e. residential blocks.

When Will it be Enforced?
The revised legislations (the MDHS100), has now been issued and all non-domestic properties fall into this category. There are currently over 1.7 million properties to be surveyed with very few surveyors available; because of this the HSE will allow time for the new duty to be introduced.

Who Carries the Responsibility?
Building managers, property management, employers and the owners bear the responsibility to arrange for the survey to be carried out, which means you will be legally bound to manage the asbestos in the premises, or have a company manage the asbestos for you. How Much Does it Cost? This depends on the scale of the premises and the amount of samples needed to be taken, an experienced survey will be able to estimate the amount of samples needed on the site visit and walk through.

The Asbestos Survey & Register
The Working Asbestos Registers is documentation of materials and/or suspected materials that contain asbestos within premises, which is kept on the premises. Any persons carrying out maintenance work or work of any kind within the premises must first view the asbestos register to ascertain if asbestos is present in the area where they are about to work. The reason for this is to prevent accidental damage to the asbestos containing materials that might cause fibre release contaminating the area.

You Are Responsible
It is the duty of every employer to ENSURE that the requirements (a suitable and sufficient assessment) of draft 4 of the Control of Asbestos at Work regulation 2002 are carried out as to weather asbestos is or is liable to be present in non-domestic premises occupied by him and in which persons work. And all other parties who have, by virtue of any contract or tenancy, an obligation in relation to the maintenance or repair of the premises (or any means of access/egress to/from them) to take such measures as are necessary so far as is reasonable, given the nature and extent of the obligation, to enable the employer to comply with the requirements of this regulation.

The Need For An Asbestos Register
It has been known for many years that exposure to asbestos fibers can lead to unpleasant health effects. It was originally thought that high exposures to asbestos was the cause of most illnesses, but research shows that short term exposures can be just as damaging.. The control of Asbestos at Work (amended) Regulations 2002 currently require the identification of asbestos types for any workers liable to be exposed to asbestos, and a register of materials should provide the necessary data. The Health & Safety Commission has placed explicit duties on people in control of premises to locate materials likely to contain asbestos and keep an up-to-date register of their locations and conditions.

Updates And Reviews
Updating the register is an important part of the management plan even if there are only a few examples to up-date. Regular audits will encourage fine-tuning of the procedures and improvements that will have to be made to the asbestos management system. Also to see if the register is being kept in the correct place and that no documents have been damaged or are missing,

All the records on the register should be re-inspected usually on annual base, and if changes have occurred to the material then re-assessment of the risk to health will take place.
